Terms & Conditions

These Terms & Conditions apply to coaching, lessons, camps, trips, guiding and other services provided by FORM Snowboarding (“FORM”).

By making a booking or paying a deposit, the client confirms that they have read and accepted these Terms & Conditions.

1. Bookings

A booking is only confirmed once FORM has accepted the booking and the required deposit has been received.

Unless otherwise stated, a 50% deposit is required to secure a booking.

The remaining balance must be paid by the deadline given at the time of booking.

If payment is not received by the agreed deadline, FORM may treat the booking as cancelled and release the reserved dates.

Prices do not include lift passes, equipment hire, travel, accommodation, food, insurance or other personal expenses unless specifically stated.

2. Deposits

Deposits are non-refundable, except where FORM cancels the service and cannot offer a suitable alternative, or where a refund is required by applicable law.

The deposit reserves coaching time and prevents that availability from being offered to another client.

Where a client chooses to cancel, the deposit will not normally be transferred to another person or booking unless agreed by FORM.

3. Client Cancellations

Cancellations must be made in writing by email.

For private coaching and lessons:

More than 30 days before the booking:
Any amount paid above the 30% deposit will be refunded.

8–30 days before the booking:
50% of the total booking price is payable.

7 days or less before the booking:
100% of the total booking price is payable.

If the client does not attend, arrives too late for the session to reasonably take place, or chooses to stop the session early, no refund will be provided.

Different cancellation conditions may apply to camps, trips, accommodation packages or other services involving third-party costs. These will be communicated before booking where applicable.

4. Changing Your Booking

FORM will try to accommodate reasonable requests to change dates or times but cannot guarantee that changes will be possible.

Changes are subject to coach availability.

A change requested by the client may be treated as a cancellation where FORM cannot reasonably accommodate the new date.

5. Weather, Snow & Visibility

Snowboarding and skiing take place in a changing mountain environment.

Snowfall, poor visibility, wind, cold temperatures, rain, difficult snow conditions or a client's preference not to ride in the prevailing conditions are not in themselves grounds for a refund.

FORM will make reasonable efforts to adapt the terrain, meeting point, timing or content of the session to the conditions.

6. Lift & Resort Closures

If the relevant resort or lift system is completely closed and the booked service cannot reasonably take place, FORM will first try to:

• move the session to another suitable area;
• change the timing; or
• rearrange the booking.

If FORM cannot reasonably provide the booked service or a suitable alternative, any refund or credit due will be determined in accordance with applicable law and the circumstances of the booking.

Partial lift closures or limited terrain do not automatically entitle the client to a refund where the session can still reasonably take place.

7. Cancellation by FORM

FORM may change or cancel a session where necessary because of safety, coach illness or injury, mountain conditions, official restrictions or circumstances outside FORM's reasonable control.

Where FORM cancels for reasons within its control and cannot provide a suitable replacement coach, date or equivalent service, the client will receive a refund for the service FORM has been unable to provide.

FORM is not responsible for consequential costs such as flights, accommodation, transport, equipment rental or lift passes except where liability cannot legally be excluded.

Clients are therefore strongly advised to have appropriate travel and cancellation insurance.

8. Safety & Mountain Environment

Snowboarding, skiing, freeriding and mountain activities involve inherent risks.

These include, but are not limited to, falls, collisions, changing weather and snow, rocks, trees, cliffs, crevasses, avalanches and other natural or man-made hazards.

FORM coaches will use their professional judgement to manage risk and select terrain appropriate to the participants and conditions. However, mountain sports cannot be made completely risk-free.

Clients must follow reasonable instructions given by their coach.

The coach has final say over terrain selection and whether an activity can safely take place.

Nothing in these Terms & Conditions excludes or limits liability where doing so would be prohibited by applicable law.

9. Off-Piste & Freeride

For off-piste or freeride sessions, clients may be required to carry appropriate avalanche safety equipment, normally including:

• avalanche transceiver
• shovel
• probe

Additional equipment may be required depending on the planned terrain and conditions.

Clients must know how to use required safety equipment or follow the coach's instruction regarding its use.

FORM may change the planned route, terrain or activity at any time where the coach considers this necessary for safety.

A decision not to enter particular terrain for safety reasons does not constitute a failure to provide the booked service.

10. Client Ability

Clients must give an honest description of their skiing or snowboarding ability and experience when booking.

FORM cannot guarantee access to particular terrain, runs, parks or off-piste areas.

Terrain and coaching content will be selected according to the client's ability, conditions, safety and the coach's professional judgement.

11. Health & Fitness

Clients are responsible for ensuring that they are physically capable of participating in the booked activity.

Clients must inform FORM before the session of any relevant injury, condition, medication or other circumstance that could reasonably affect their safe participation.

Where the coach considers that continuing would create an unreasonable risk, they may modify or stop the session.

12. Equipment

Clients are responsible for having suitable and properly functioning equipment.

FORM may refuse or modify participation where equipment is considered unsuitable or unsafe.

Clients are responsible for obtaining the correct lift pass unless expressly included in the booking.

Time lost because a client needs to purchase a lift pass, hire equipment or resolve equipment problems will normally form part of the booked session.

13. Late Arrival

Sessions begin and finish at the agreed times.

If a client arrives late, FORM will make reasonable efforts to provide the remainder of the session, but the finishing time will normally remain unchanged.

No refund will be provided for time lost due to client lateness.

14. Groups

For group bookings, the person making the booking is responsible for providing accurate information regarding the abilities and requirements of the participants.

The coach will select terrain and session content appropriate to the group.

Where significant differences in ability affect safety or the reasonable delivery of the session, the coach may modify the programme.

15. Children

Bookings for participants under 18 must be made or authorised by a parent or legal guardian.

The parent or guardian must provide accurate information about the child's ability and anything relevant to their safe participation.

Drop-off and collection arrangements must be agreed with the coach.

16. Behaviour

Clients must behave responsibly and must not deliberately place themselves, their coach or other mountain users at unreasonable risk.

FORM may immediately stop a client's participation where they:

• repeatedly ignore safety instructions;
• behave dangerously;
• are abusive towards the coach or others; or
• are impaired by alcohol or recreational drugs.

Where a session is ended for these reasons, the client will not normally be entitled to a refund.

17. Insurance

Clients are strongly advised to have appropriate personal insurance covering their activities.

This should include, where appropriate:

• skiing and snowboarding;
• off-piste/freeride activities;
• freestyle activities;
• mountain rescue;
• medical expenses;
• repatriation; and
• cancellation.

It is the client's responsibility to check the terms and exclusions of their insurance policy.

18. Camps & Trips

Camps, trips and multi-day programmes may involve accommodation providers, transport operators, lift companies and other independent third parties.

Additional booking conditions may therefore apply.

Itineraries are always subject to mountain conditions and may be changed for safety, weather, operational or logistical reasons.

A change of itinerary does not automatically entitle a participant to a refund where FORM continues to provide a reasonably equivalent service.

Any material additional terms will be communicated before the relevant booking is confirmed.

19. Photography & Video

Photos and videos may occasionally be taken during FORM sessions.

FORM will obtain appropriate permission before using identifiable images of clients for promotional purposes.

Clients who do not wish to appear in photographs or video should tell their coach.

20. Personal Property

Clients remain responsible for their own equipment and belongings.

FORM is not responsible for loss, theft or damage except where FORM is legally liable.

21. Circumstances Outside FORM's Control

FORM will not be responsible for failure or delay in providing a service where caused by circumstances outside its reasonable control, subject always to the client's rights under applicable law.

Such circumstances may include extreme weather, exceptional avalanche danger, major lift or resort closures, road closures, transport disruption, natural events or restrictions imposed by public authorities.

FORM will make reasonable efforts to provide an alternative where practicable.

22. Complaints

If you are unhappy with any part of a FORM service, please raise the issue with your coach as soon as possible so that there is an opportunity to resolve it.

Formal complaints should be submitted in writing to FORM.

FORM will attempt to resolve complaints directly and reasonably.

If a consumer dispute cannot be resolved directly, the client may have the right to use the consumer mediation service designated by FORM.

23. Applicable Law

FORM is established in France and these Terms & Conditions are governed by French law, subject to any mandatory consumer protections that apply to the client.

Nothing in these Terms & Conditions limits or excludes rights that cannot legally be excluded.

24. Acceptance

By confirming a booking and paying the required deposit, the client confirms that they have:

• read and accepted these Terms & Conditions;
• provided accurate information relevant to the booking; and
• agreed to the booking, payment and cancellation conditions.
